General terms and conditions of business

1. Scope

These General Terms and Conditions (GTC) apply to all contracts, deliveries and services between Comfy Studios, Freiherr-vom-Stein-Straße 6, 76726 in Germersheim (hereinafter referred to as "Seller") and consumers who order children's clothing via the online shop https://comfystudios.de .
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (§ 13 BGB).
Any differing terms and conditions will not be recognized unless the seller expressly agrees to them.

2. Contracting parties and conclusion of the contract

The purchase agreement is concluded with Comfy Studios, Freiherr-vom-Stein-Straße 6, 76726 in Germersheim, E-Mail: info@comfystudios.de.
The product presentation in the online shop is not a legally binding request, but rather an invitation to place an order.
By placing an order, you are submitting a binding offer. After receiving your order, you will receive an automatic confirmation of receipt via email. The purchase agreement is concluded upon dispatch of the separate order/shipping confirmation.
The contract is concluded exclusively in German.
The ordering process allows for corrections and cancellation of the order before it is submitted.

3. Prices and payment terms

All prices are final prices in accordance with § 19 UStG (small business regulation), therefore no VAT is shown. Shipping costs are displayed during the order process and must be paid in addition.
The following payment methods are available in the shop:

  • EPS transfer
  • Klarna (invoice, instant bank transfer, installment purchase)

The available payment methods are displayed during the order process. The terms of service and privacy policies of external payment providers apply to their use. When selecting certain payment methods (e.g., PayPal, Klarna, Apple Pay, Google Pay), your personal data will be transferred to the respective payment provider for payment processing. Details can be found in our privacy policy.
Payment of the purchase price is due immediately upon conclusion of the contract. Ownership of the goods transfers upon receipt of full payment.

4th delivery

Deliveries are made within Germany and to the member states of the European Union.
Delivery within Germany typically takes 1–3 business days after receipt of payment. Up-to-date information on shipping methods, delivery times, and return options can be found on our website under the menu item "Shipping & Returns".
Should an item be unavailable, we will inform you immediately. Any payments already made will be refunded without delay.
The risk of accidental loss or damage to the goods passes to you upon delivery of the goods.

5. Right of withdrawal

Consumers have a statutory right of withdrawal of 14 days from receipt of the goods.
The right of withdrawal does not apply to individually manufactured goods or to seals that have been removed after delivery for hygienic reasons.
You can find the exact cancellation policy separately on the website or in the order confirmation.

6. Retention of title

The goods remain the property of the seller until full payment has been received.

7. Warranty

The statutory warranty rights apply.
In case of defects, you are entitled to subsequent performance (repair or replacement). If this fails, you can demand a price reduction or withdraw from the contract.

8. Liability

Liability for intent and gross negligence is unlimited.
In cases of slight negligence, we are only liable for breaches of essential contractual obligations ("cardinal obligations") limited to the typically foreseeable damage.
Liability for damages to life, body and health remains unaffected.

9. Special notes on children's clothing

Textile goods can be returned under the right of withdrawal, provided they are unworn and undamaged.
For hygiene reasons, returns are not accepted for underwear if the seal has been removed.

12. Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Should any provision of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
